California’s dog bite law

Negligence – A negligence claim may sometimes be brought when a strict liability claim is not appropriate. In these cases, the dog bite victim must prove that the dog owner’s negligence caused his or her injuries. For example, if an off leash dog in a public park jumped on an elderly adult causing a broken hip or a child causing a traumatic brain injury, the injury victim would have to prove that the owner’s negligence in letting his or her dog off leash caused the victim’s injuries.

Specific exceptions to California’s dog bite law

  • When a dog bites an employee who is working for the dog’s owner, the dog bite victim is generally not able to bring a strict liability or negligence claim against the dog owner. There are recovery options though, but it would typically fall under a workers’ compensation claim.
  • Police and military dogs may bite without liability under California law when assisting in official military or police duty. Innocent bystanders who suffer dog bite injuries may be permitted to recover, however.
  • There is no dog bite liability when the dog bite victim provoked the dog prior to the bite.
  • Trespasser and provocation defenses do not apply to children under the age of 5.
  • In cases of pet handlers such as dog walkers, dog trainers, and veterinarians, they are generally viewed as having assumed the risk of suffering dog bites based on the nature of their business, but there are some exceptions to this.
