How Does This Happen?

Wage garnishments occur when a creditor is legally allowed to take payments directly from your regular paycheck because of a debt you owe. Some debts can be garnished without a creditor filing a lawsuit against you while others require a court order. Some debts that can be garnished include:

Will Bankruptcy Stop Wage Garnishments?

Filing for bankruptcy is a way to either eliminate most outstanding debt (Chapter 7) or renegotiate a payment plan with creditors (Chapter 13) and could be an option to stop wage garnishments. However, some of the debts discussed above cannot be eliminated in bankruptcy. This includes court-ordered child support, alimony payments, back taxes, and student loans.

However, credit card debts, medical debts, and other personal loans can typically be discharged or worked into a repayment plan during the bankruptcy process, potentially eliminating wage garnishments.
